Mitigation banking credits can help land developers comply with state and federal environmental regulations by allowing a developer to compensate for unavoidable wetland impacts on their development property through the purchase of mitigation credits from a wetlands bank within the same watershed as the project, thereby offsetting impacts to streams, wetlands, and other water resources. In-Lieu Fee Mitigation For Streams & Wetlands 

An in-lieu fee program uses third-party, public agencies or non-profit organizations to create wetland mitigation banks, which produces credits that a developer can purchase to compensate for impacts to streams and wetlands on their development property.  Under an in-lieu fee program, the third party collects funds from permittees to create mitigation bank sites that can compensate for aquatic resources lost due to development.

Permittee-Responsible Mitigation For Streams & Wetlands 

In the event that a watershed does not have mitigation credits from an approved mitigation bank, an alternative option for satisfying the compensatory mitigation requirement for developers is providing permittee-responsible mitigation (PRM).   The process is similar to establishing a mitigation bank with the main difference being that the PRM site provides the compensatory mitigation solution for one project (vs a mitigation bank that can service numerous projects throughout the watershed).
